BizzSms attaches great importance to the protection of personal data. This privacy statement explains how we handle data of visitors to www.bizzsms.nl, of customers using the customer environment klanten.bizzsms.nl and of people who contact us.
1. Who we are
- 1.1BizzSms, located at Stationsstraat 5, 5038 EA Tilburg, the Netherlands, and registered with the Dutch Chamber of Commerce under number 62074644, is responsible for the processing of personal data as described in this privacy statement.

2. Our role: controller or processor
- 2.1We are the controller for data of website visitors, customers and customers’ contact persons. This privacy statement covers that processing.
- 2.2Customers send SMS messages through BizzSms and can store contacts in the customer environment. For the phone numbers, message content and contact details customers use for this, the customer is the controller and BizzSms acts as processor. If you received an SMS sent through BizzSms and have a question about your data, please contact the sender of the message. We help the sender handle your request.
3. What data we process and why
- 3.1Contact form: your name, company name, email address, phone number and question, to answer your question. Legal basis: our legitimate interest in answering questions from (potential) customers.
- 3.2Creating an account: your username, password (stored encrypted), name, company name, email address and phone number, to create your account and give you access to the service. Legal basis: performance of the contract.
- 3.3Using the customer environment: your login details, two-factor authentication settings, IP address and browser details of your sessions, the messages you send and a log of failed API requests, to provide and secure the service and prevent misuse. Legal basis: performance of the contract and our legitimate interest in a secure service.
- 3.4Orders and invoicing: your billing details, such as company name, address and VAT number, and your order and credit history, to process orders and invoice them. Legal basis: performance of the contract and the statutory tax retention obligation.
- 3.5Service emails: your email address, to inform you about your account, for example when your balance is running low or when our terms change. Legal basis: performance of the contract.
- 3.6Spam protection: on the sign-up form we use Google reCAPTCHA to check whether the form is filled in by a human. Google processes, among other things, your IP address and information about your browser and behaviour on the page. Legal basis: our legitimate interest in preventing misuse of the sign-up.
- 3.7Measuring advertising: with Google Ads conversion tracking we measure whether visitors create an account or contact us after clicking an advertisement. Legal basis: your consent.
4. Cookies
- 4.1On www.bizzsms.nl, Google Ads places cookies to measure advertising conversions. We only place these cookies if you have given your consent. You can withdraw your consent at any time.
- 4.2In the customer environment klanten.bizzsms.nl we only use functional cookies needed to log in and stay logged in: a session cookie (up to 7 days), a cookie during two-factor authentication (10 minutes) and, if you choose so, a cookie to remember a trusted device (30 days). We also store preferences such as your display settings in your browser.
5. How long we keep data
- 5.1We do not keep personal data longer than necessary for the purpose for which we process it.
- 5.2We keep contact requests for up to 2 years after your question has been handled.
- 5.3We keep account data for as long as your account exists. After your account is closed, we delete this data within 3 months.
- 5.4We keep sent messages and delivery reports for up to 12 months after sending, so that you can view your sending history.
- 5.5We keep the log of failed API requests for 90 days.
- 5.6We keep invoice and order data for 7 years, as required by law.
6. Sharing with third parties
- 6.1We do not sell your data. We only share personal data with parties that help us provide the service, and only to the extent necessary. We make agreements with these parties about the security and confidentiality of your data.
- 6.2Our website and customer environment are hosted on Google Cloud Platform, in data centres within the European Union.
- 6.3We also work with email service providers and with telecom operators that deliver SMS messages.
- 6.4We may disclose data when legally required to do so, for example at the request of a regulator or in an investigation into misuse.
7. Transfers outside the EEA
- 7.1Some of our service providers, including Google, (also) process data outside the European Economic Area. In that case we ensure appropriate safeguards are in place, such as certification under the EU-US Data Privacy Framework or the standard contractual clauses of the European Commission.
8. Security
- 8.1We take appropriate technical and organisational measures to protect personal data, such as encrypted connections, encrypted storage of passwords, two-factor authentication, limited access for employees and logging of security events.
- 8.2If you believe your data is not properly secured or there are signs of misuse, please contact us immediately at info@bizzsms.nl.
9. Your rights
- 9.1You have the right to access, correct or delete your personal data. You can also ask us to restrict processing, object to processing and receive your data in a commonly used format. If you have given consent, you can withdraw it at any time.
- 9.2Send your request to info@bizzsms.nl. We respond within one month. To prevent misuse, we may ask you to verify your identity.
10. Complaints
- 10.1If you are not satisfied with how we handle your data, please contact us first. You also have the right to lodge a complaint with the Dutch Data Protection Authority (Autoriteit Persoonsgegevens) via autoriteitpersoonsgegevens.nl.
11. Changes
- 11.1We may amend this privacy statement. The latest version is always available on this page. In the event of material changes, we inform customers by email.
- 11.2This privacy statement is a translation of the Dutch version. In the event of any discrepancy, the Dutch text prevails.
